Warranty Certificate

 

The quality assurance period

12 months or 2000 hours from the date of delivery for standard specification product, whichever comes first is                                        regarded as the end of quality assurance period.
When non-standard specification designated by FOTMA is installed (such as hydraulic hammer), the quality assurance period covers 6 months or 1000 hours.
Special offer products stated prior to the customer (including second-hand excavator) and excavators sold for the second time do not comply with the above regulations. The contract shall prevail.

Quality assurance responsibility

During the quality guarantee period, if there is any part defect in designing and manufacturing, the company has the obligation for free repair or replacement and the right to recover the replaced parts without any other costs or loss. If fault occurs, customer should notify the company in 24 hours the fault and take necessary measures to reduce loss. Otherwise the company will not be responsible for consequential faults and loss.
In the quality guarantee period, the following does not belong to the scope of quality assurance.

I. Loss or fault due to accidents, improper use or storage, negligence, intention, disaster or harm caused by the third.

II. Loss or defect caused by change or modification of excavator such as unauthorized hammer, hydraulic shear without the company or prior authorization of the company, and the use of spare parts of other companies or accessories installation.
III. Personnel other than the company service staff or the company authorized service staff carry out the repair or modification, affecting the performance of the unit and use.
IV. Failure or defect due to poor operation or maintenance disregarding instructions or guidance and special site unsuitability of the unit, for instance, excavating rock with standard bucket, wheel loaders for excavation, damaging bucket, bucket rod, boom, and the lower frame.
V. Fault caused by using fuel or parts not supplied by FOTMA.

The fuel must be used in accordance with Chinese GB standard grade. Fuel, engine oil, hydraulic oil, lubricating oil must be supplied by FOTMA. Filters must be FOTMA parts.
VI. Excavator traveling motor is not suitable for long time and long distance running. Fault of traveling motor caused by continuous traveling is not under warranty.
Others

I. In the process of normal obligatory repair, customer should cooperate with the company actively and properly. If the customer refuses to cooperate, for example, hiding excavator working site, intentionally damaging the working meter, GPS system and making other obstacles, the company has the right to terminate the service, and the loss is undertaken by the customer.
II. Excavators should work below 2000m or atmospheric temperature below 40. Otherwise the company is not responsible for malfunction or defect.

III. In the quality assurance period, if same fault of important excavator parts such as engine, hydraulic pump, main valve, traveling motor, rotary motor, boom, bucket rod, upper frame, lower frame occur three or more than three times and normal function can not be restored, customer has the right to request the supplier to replace new parts. Customer has the right to apply for replacing or returning the unit in particularly serious situation.
IV. The guaranty is only for repairing and replacing defective parts, which will be decided only by FOTMA company or authorized agent. Preventing FOTMA service personnel or FOTMA authorized agent service personnel carrying out essential inspection or repair and returning the
old parts to FOTMA will perform influence on FOTMA service obligations. FOTMA company is not liable for the loss or the expanding loss caused by this.
V. FOTMA company does not undertake the indirect loss caused by product faults nor the spiritual, moral loss or project loss due to product malfunction.

VI. The company and the customer will be considered to accept all the items of this regulation if there is no special written agreement. Attachment: warranty details for main parts and relevant materials of excavator.
